Listy, LLC (“Listy,” “we,” “our,” or “us”) respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy explains what we collect, how we use it, and the choices you have. Listy is both a Florida real estate brokerage and a software platform sellers use to prepare and manage a listing, and this policy covers both roles.
Information We Collect
We collect information you provide directly when you create an account, complete seller onboarding, submit a contact form, or communicate with our team. This may include:
- Name, email address, phone number, and mailing address
- Property details and listing information
- Account credentials and onboarding responses
- Order, payment status, and refund records from purchases
- Messages, documents, disclosures, signatures, and media you provide, upload, complete, or submit in connection with your listing or transaction
Private Information vs. Listing Information
Not everything you share with Listy is treated the same way. We distinguish between information we keep private and information you submit for the purpose of publishing your property.
Private seller, account, and transaction information is not published. Depending on the context, this may include your contact and account information, authentication information, private portal messages and attachments, purchase and closing documents, other private transaction documents, and payment, order, and refund records.
Property listing information intended for publication is submitted for public distribution. Depending on the context, this may include the property address, list price, property characteristics, the public listing description and remarks, listing status, the listing photographs you select, and other information submitted or required for MLS or public listing purposes.
MLS Publication and Syndication
Information intended for property-listing publication may be submitted to one or more multiple listing services (MLSs), distributed through MLS data feeds, syndicated to real estate websites and platforms, and made available to brokers, agents, MLS participants, and other recipients through applicable listing-distribution systems.
Once listing information has been distributed by an MLS or another third party, copies may be displayed, cached, retained, redistributed, or maintained by those recipients outside Listy's direct control. We cannot promise removal of listing information from the internet, from MLS historical records, from third-party websites, from cached copies, or from downstream recipients.
How We Use Your Information
- To provide and improve our listing and brokerage services
- To process payments and manage your account
- To prepare and publish MLS listings on your behalf
- To communicate with you about your listing, support requests, or account
- To send transactional, service, and relationship communications
- To detect, prevent, and address fraud or misuse
- To comply with legal and regulatory obligations
Payment Processing
Payment card information is collected and processed through a hosted third-party payment processor. Listy does not receive or store your full payment card number. We store the transaction information needed to administer your purchases and refunds, which may include checkout and payment identifiers, the amount, the products or services purchased, payment status, receipt or invoice information, refund information, and related transaction metadata. The processor's handling of your payment data is governed by its own privacy policy.
Sharing of Information
We do not sell your personal information, and we do not operate a business model that monetizes customer data through targeted or cross-context behavioral advertising. We share information only as needed to operate our services, including with:
- MLS systems and real estate platforms required to publish your listing
- Service providers in categories such as hosting and infrastructure, authentication, database and storage, payment processing, email and communications, electronic signature and document delivery, listing distribution, photography and media, product fulfillment and shipping, and other service fulfillment
- Parties reasonably necessary to provide brokerage and transaction services, including professional and transaction-support partners where applicable
- Authorities when required by law or to protect our rights
Where Listy provides brokerage or representation services, the handling, confidentiality, and authorization obligations for a specific transaction may also be governed by the applicable representation or listing agreement.
Cookies and Browser Storage
Listy uses cookies and similar browser storage that are functional and necessary to operate the site and Seller Portal — for example, to keep you signed in, maintain your session, remember which property you are working on, and store interface preferences. We do not currently use third-party analytics, advertising or behavioral tracking, session replay, fingerprinting, or advertising pixels. You can control cookies through your browser settings; disabling certain cookies may prevent the portal from working correctly.
Email Communications
Listy currently sends transactional, service, and relationship emails — for example, account setup and confirmation, password and account events, purchase confirmations, listing status updates, service updates, responses to seller requests, and brokerage or transaction communications. We are not currently operating a general newsletter or promotional marketing email program. We will continue to send essential account and transaction communications related to your active services.
Data Security
We use reasonable administrative, technical, and physical safeguards to protect your information, including access controls that separate each seller's account, listing, document, and message data. No method of transmission or storage is completely secure, but we work continuously to protect your data. If a data-security incident occurs, we will provide notices as required by applicable law.
Data Retention
We retain information for as long as reasonably necessary to provide our services, maintain brokerage, listing, and transaction records, administer accounts, process orders and refunds, comply with legal and regulatory obligations, resolve disputes, enforce agreements, prevent fraud and security abuse, and maintain appropriate business and audit records.
As a Florida real estate brokerage, Listy is required to retain certain brokerage business records for a minimum period set by law, and those records are kept for at least that period regardless of account status. When information is no longer reasonably needed and no retention obligation applies, we may delete, de-identify, or securely dispose of it.
Communications with Listy and through the Seller Portal, along with documents and transaction activity, may be retained as part of your account, listing, service, transaction, brokerage, support, or compliance record. Removing something from normal display in the portal does not necessarily mean the underlying record has been permanently erased.
Your Rights and Privacy Requests
You may have rights under applicable law to access, correct, delete, or limit how we use your personal information. To make a request, contact us at hello@listy.net and we will handle it as appropriate under applicable law.
We may need to retain information where reasonably necessary or legally required — for brokerage recordkeeping, legal and regulatory compliance, financial and accounting records, fraud prevention, security, disputes, enforcement of agreements, and other legitimate retention purposes. A deletion request does not override legally required brokerage record retention, and it cannot remove listing information that has already been published through an MLS or distributed to third parties.
Third-Party Websites
Our site and communications may link to third-party websites and services that we do not control. Those parties have their own privacy practices, and we encourage you to review them.
Children's Privacy
Our services are not directed to children under 13, and we do not knowingly collect personal information from children under 13.
Changes to This Policy
We may update this Privacy Policy periodically. Updates will be posted on this page with a revised effective date.
