By accessing or using Listy's website, Seller Portal, or services, you agree to these Terms of Service.
If you do not agree with these terms, please do not use our website or services.
2.About Listy
Listy is a licensed Florida real estate brokerage offering MLS listing packages, full-service listing representation, and related real estate services, supported by an online Seller Portal used to facilitate portions of the seller experience.
Our services are designed to help homeowners market and sell their property while maintaining flexibility based on the package they select.
3.Professional Services Disclaimer
Listy is a licensed Florida real estate brokerage and provides real estate brokerage services in accordance with applicable Florida law. While we provide guidance throughout the home selling process, Listy does not provide legal, tax, accounting, or financial advice. Clients should consult their own attorney, accountant, tax professional, or other qualified advisor regarding any legal, tax, financial, or other professional matters related to the sale of their property.
4.How These Terms Work With Other Agreements
Several documents may apply to your relationship with Listy:
- These Terms govern use of the Listy website, the Seller Portal, online purchases, and general Listy services.
- A separately executed listing or representation agreement governs the brokerage relationship and transaction-specific representation terms for your property.
- Our Refund Policy governs refund eligibility for applicable online purchases.
- Our Privacy Policy governs Listy's privacy practices.
If a separately executed listing or representation agreement contains a provision that conflicts with these general Terms regarding the brokerage relationship or transaction-specific representation, that agreement controls for that subject matter.
5.Services Offered
Listy may provide services including:
- MLS listing packages (Basic, Standard, and Premium)
- Full-Service Listing Representation (request-based)
- Professional photography and drone photography
- Virtual staging and video
- Comparative Market Analysis (CMA)
- Seller Portal access
- Additional marketing services
Services vary based on the package or add-ons purchased.
6.Listing Packages
Package-specific features, limits, and listing durations are those presented for the package at the time of purchase. In summary:
- Listy Basic includes a 6-month MLS listing term and supports up to 24 listing photos.
- Listy Standard includes a 12-month MLS listing term and Listy's Maximum MLS Photo Allowance.
- Listy Premium includes a 12-month MLS listing term, Listy's Maximum MLS Photo Allowance, professional HDR photography, aerial drone photography, and a Comparative Market Analysis.
"Maximum MLS Photo Allowance" means up to the maximum number of listing photos permitted by the applicable MLS. Actual limits vary by MLS. The Seller Portal supports direct upload of a set number of photos; if you have more eligible photos than the portal accepts, Listy may arrange another method of receiving additional eligible photos for MLS submission.
Services provided are limited to those included in the purchased package and any purchased add-ons. Additional services requested outside the purchased package may require additional fees.
7.Full-Service Representation
Full-Service Representation is not an ordinary self-service online package purchase. It is request-based, separately reviewed by Listy, and custom-quoted where applicable.
Full-Service Representation is provided only under a separately executed listing or representation agreement, which governs the transaction-specific brokerage representation and applicable compensation or fees. Purchasing Basic, Standard, or Premium does not provide Full-Service Representation.
8.Add-On Services
Add-ons are optional services purchased in addition to a listing package.
Availability and eligibility for an add-on may depend on your listing's stage, property location and characteristics, provider availability, and the package purchased. Certain services are request-based rather than ordinary online checkout products, and some services cannot be purchased repeatedly for the same listing.
9.Pricing & Payments
All pricing, and any applicable adjustments, are disclosed before checkout. The amount presented for your confirmation at checkout is the amount authorized for that transaction.
Payment is required before services begin unless otherwise stated.
Purchases are one-time charges. Listy does not create subscriptions, recurring charges, auto-renewals, or automatic package upgrades.
Package and add-on availability and pricing may change on a prospective basis. Changes do not retroactively alter completed purchases unless you separately agree to a package or service change.
Stripe is used to securely process online payments.
10.Package Changes
You may request a package change from the Seller Portal while your listing is eligible at its current stage.
- Each request is reviewed individually by Listy.
- Submitting a request does not itself change your package or charge you.
- If an approved change requires additional payment, Listy will communicate any additional amount due before processing it.
- Package changes may be unavailable after terminal listing stages such as withdrawal or closing.
Approval is not automatic, and package changes do not create proration, credits, or refunds for unused portions of a package except as provided in the Refund Policy.
11.Account Registration
Users may be required to create an account to access certain features.
You are responsible for:
- Providing accurate information
- Maintaining your login credentials
- Keeping your contact information current
- Protecting your account
12.Seller Portal
Listy may provide access to a secure online Seller Portal, which is intended for:
- Submitting and managing listing and setup information
- Uploading photos and documents
- Communicating with the Listy team
- Reviewing purchased services and orders
- Viewing listing progress and status
Not every brokerage function occurs inside the portal. Listing paperwork, MLS activity, vendor services, and certain transaction communications may take place outside the portal. Features may change as the platform evolves.
13.Electronic Communications
You agree that Listy may provide notices, disclosures, documents, transaction communications, and account communications to you electronically — through the Seller Portal, email, or other electronic means used in connection with the services. You may request a paper copy of a communication where applicable, and you should keep a valid email address on file so you continue to receive these communications.
14.Listing Paperwork & MLS Activation
To activate an MLS listing, Listy must receive:
- Completed MLS information
- Required property disclosures
- Any applicable supporting documentation
- Listing photos (or scheduled photography)
- Payment confirmation
- The executed listing agreement and any other required brokerage or listing documents
Listy will prepare and provide any required listing agreements, disclosures, or other brokerage or listing documents separately for electronic signature or completion. Required documents may vary depending on the property and circumstances. All required listing paperwork must be completed and received by Listy before the listing can be activated on the MLS.
Most listings are published to the MLS within 24 hours after Listy has received the completed property information, all required signed listing paperwork, and required photos or other media, and the listing has completed Listy's review process, excluding Sundays and holidays.
15.Listing Content & Seller Accuracy
You are responsible for reviewing your listing information before submission, and for:
- Ensuring the factual property information you supply is accurate
- Reviewing and approving listing remarks and descriptions
- Correcting errors you identify
- Ensuring the claims and representations you provide are truthful
Listy may provide templates, prompts, drafting tools, or other assistance to help you prepare listing content. Any such assistance is a starting point only and does not relieve you of responsibility for reviewing the information you provide. Listy performs its own review as a licensed brokerage and remains subject to the duties applicable law and MLS rules impose on the broker.
16.MLS Publication & Syndication
Listing information you submit is intended for publication. Once it is entered into the MLS, it may be distributed through MLS data feeds and may appear on third-party real estate websites, brokerage websites, and the systems of other MLS participants.
Third parties may cache, copy, retain, or continue to display listing information. Listy does not control all downstream publication and cannot guarantee immediate correction or removal from third-party systems after an MLS change, correction, or withdrawal.
This applies to listing information intended for publication. Private seller communications, contracts, payment records, and portal documents are not published or syndicated.
17.Showing Scheduling
Where a package includes automated showing scheduling, that functionality is provided through ShowingTime or a comparable showing service made available by the applicable MLS, and is enabled or configured as part of listing setup where supported. It is a third-party service rather than Listy software. Availability, features, and performance vary by MLS and may be subject to outages, limitations, or changes outside Listy's control.
18.Buyer Inquiries
Buyer inquiries that Listy receives as listing broker may be passed along to you. Showing requests may also be routed directly to you through the applicable MLS or showing service based on your listing configuration.
Third-party real estate websites operate their own consumer lead-routing systems. Listy cannot guarantee that every consumer inquiry generated by a third-party website will be delivered to Listy or to you.
19.Open Houses
MLS open-house scheduling is included with Listy Standard and Listy Premium; it is not included with Listy Basic. Where a package is described as including unlimited MLS open house scheduling, "unlimited" refers to Listy's package-level limit and remains subject to your active listing term, listing status, applicable MLS rules, and reasonable scheduling and operational requirements. Listy schedules and posts the open house to the MLS; it does not host or staff the open house unless that is separately agreed.
20.Photography, Marketing & Physical Add-On Services
Photography, drone services, virtual staging, video, and other marketing services are scheduled separately after purchase.
Scheduling is subject to provider availability and service area, and weather may require rescheduling. Completion times may vary.
Drone services are additionally subject to weather, safety considerations, FAA and airspace restrictions, property conditions, and other operational limitations.
Photography and media pricing may vary based on property size. Any applicable property-size adjustment is disclosed before checkout.
Physical add-ons, including signs and lockboxes where offered, may require production, fulfillment, shipping, or delivery by third-party providers. Estimated fulfillment or delivery times are not guaranteed and may be affected by provider availability, carrier delays, weather, holidays, property location, or other circumstances outside Listy's control. Unless otherwise stated, delivery of a physical add-on is not required before an otherwise listing-ready property can be published to the MLS.
Once a vendor has been booked or fulfillment has begun, refund eligibility may be affected as described in the Refund Policy.
21.Seller Responsibilities
Homeowners remain responsible for:
- Providing accurate property information
- Disclosing known material facts
- Reviewing listing information before publication
- Responding to offers
- Cooperating with applicable MLS rules
- Maintaining property availability for showings (unless otherwise agreed)
- Completing and returning required listing agreements, disclosures, and other applicable documentation
Listy is not responsible for inaccurate information supplied by the homeowner.
22.Buyer Agent Compensation
Any offer of compensation to a buyer's broker is entirely optional and determined by the seller. Listy does not require a seller to offer compensation to a buyer's broker as a condition of listing the property. Any applicable compensation arrangements will be addressed separately from the MLS listing in accordance with applicable law, MLS rules, and the seller's listing agreement.
23.Refunds
Refund eligibility for applicable online purchases is governed by our Refund Policy, which is incorporated into these Terms.
Eligibility can depend on whether work has begun, whether MLS services have been performed, and whether add-on fulfillment or vendor booking has started.
Refunds and listing status are separate: receiving a refund does not by itself withdraw or terminate a listing, and withdrawing or terminating a listing does not by itself create a refund.
24.Listing Withdrawal & Termination
You may ask Listy to withdraw your listing from the MLS. Withdrawal is a brokerage and MLS action, not an automated portal function, and may require your instructions, documentation, or other steps before it can be completed. Obligations under a separately executed listing agreement may govern or survive termination where applicable.
Withdrawal or termination does not automatically create a refund, and a refund does not automatically withdraw or terminate a listing. Refund eligibility is determined solely under the Refund Policy.
Listy may suspend or terminate access to the portal or services in cases of fraud, unlawful conduct, material violation of these Terms, misuse of the platform, or where continued service would violate applicable law, MLS requirements, or Listy's brokerage obligations.
25.Privacy
Your use of Listy's website, Seller Portal, and services is also subject to our Privacy Policy, which explains how Listy collects, uses, discloses, retains, and protects information.
Certain listing information is intended for publication through the MLS and syndication, as described above. Brokerage records may be retained as required by applicable law even after portal access ends or a deletion request is made.
26.Record Retention
Listy may retain brokerage records, transaction records, communications, documents, payment and refund history, and other records for the periods required by applicable law or reasonably necessary for legitimate business, compliance, dispute-resolution, fraud-prevention, and recordkeeping purposes. Closing a portal account or removing information from display does not necessarily require deletion of records that Listy is required or permitted to retain. See our Privacy Policy for details.
27.Third-Party Services
Listy relies on third-party providers, including categories such as:
- MLS organizations and MLS data distribution or syndication systems
- ShowingTime or other applicable showing services
- Payment processing
- Professional photographers and media providers
- Email and communications infrastructure
- Mapping and other operational providers
- Electronic signature and document-delivery providers
- Product fulfillment, shipping, and delivery providers
Listy does not control the uptime, policies, lead routing, or downstream publication practices of third-party providers and is not responsible for outages or interruptions they cause.
28.Intellectual Property
All website content, branding, logos, graphics, software, and materials remain the property of Listy unless otherwise stated.
Content may not be copied or reproduced without written permission.
29.Limitation of Liability
While Listy strives to provide accurate information and professional services, we cannot guarantee:
- Sale of a property
- Specific marketing performance
- Buyer activity
- Showing volume
- Property value
- Time to sell
Listy's liability is limited to the maximum extent permitted by applicable law. Nothing in these Terms limits any right or remedy that cannot be limited or waived under applicable law, including duties applicable to Florida real estate brokerages.
30.Changes to Services
Listy reserves the right to modify:
- Pricing
- Packages
- Features
- Add-on services
- Website functionality
Any changes to pricing or package offerings will not apply retroactively to services already purchased, except where changes are required by law, MLS rules, third-party provider requirements, or are reasonably necessary to deliver the purchased service.
31.Changes to These Terms
Listy may update these Terms from time to time. The "Last Updated" date above reflects the current version, and continued use of the website or services after an update constitutes acceptance of the updated Terms.
32.General Provisions
Entire agreement. These Terms, together with the Refund Policy, the Privacy Policy, and any separately executed listing or representation agreement, form the agreement between you and Listy for the subjects they cover.
Severability. If any provision is found unenforceable, the remaining provisions stay in effect.
Waiver. Failure to enforce a provision is not a waiver of it.
Assignment. You may not assign your rights under these Terms without Listy's written consent. Listy may assign these Terms in connection with a merger, acquisition, or transfer of its business, subject to applicable law.
Headings. Headings are for convenience only and do not affect interpretation.
33.Governing Law
These Terms of Service are governed by the laws of the State of Florida.
